Acceptable Use Policy

This Acceptable Use Policy (“AUP”) defines the standards of acceptable conduct on Cmark, a media hosting and monetization platform operated by Infinite Ideas, LLC. By creating an account or using the Service, you agree to comply with this AUP. This policy is incorporated into our Terms of Service and should be read alongside our Privacy Policy.
1. Purpose
Cmark enables creators to upload, annotate, and share media, and enables sponsors to place brand marks on creator content. We want the platform to be a safe, trustworthy, and high-quality environment for all users — visitors, creators, sponsors, and the brands and individuals who appear in or are associated with content on the platform. This AUP sets out what conduct is acceptable and what will not be tolerated.
2. Permitted Uses
You may use Cmark to:
- Upload your own original content — images and videos you have created yourself or for which you hold the rights to upload and use commercially.
- Upload licensed content — material licensed to you by a third party for commercial use, provided that uploading and adding brand marks falls within the scope of that license.
- Promote your brand or products — add brand marks and click-through URLs to your media to drive traffic to your website, portfolio, store, or other online properties.
- Run or participate in sponsor campaigns — place sponsor brand marks on media in exchange for commercial consideration, provided all parties understand the nature of the arrangement.
- Share and embed media — distribute your Cmark media links and embeds across social platforms, newsletters, websites, and other channels.
- Analyze engagement — use the analytics features the platform provides to understand views, clicks, and performance of your media.
- Collaborate with team members — manage content, campaigns, or analytics on behalf of clients or as part of an agency, provided all activity complies with this AUP.
3. Prohibited Content
You must not upload, publish, link to, or otherwise make available through the Service any content that falls into the categories below.
3.1 Illegal or Promoting Illegal Activity
- Violates any applicable local, national, or international law or regulation.
- Promotes, facilitates, glorifies, or provides instructions for unlawful acts, including fraud, extortion, hacking, terrorism, human trafficking, or the sale of controlled substances.
- Constitutes or promotes the trade of counterfeit or stolen goods or services.
3.2 Intellectual Property Infringement
- Infringes any copyright, trademark, patent, trade secret, or other intellectual property right held by any person or entity.
- Reproduces or distributes copyrighted material without authorization from the rights holder.
- Uses brand marks, logos, or trademarks belonging to third parties in a way likely to cause confusion about origin or endorsement.
3.3 Harmful or Dangerous Content
- Contains graphic violence, gratuitous gore, or material that celebrates, glorifies, or trivializes real-world harm to people or animals.
- Promotes, encourages, normalizes, or provides instructions for self-harm, suicide, eating disorders, or other behaviors likely to cause physical injury.
- Contains material designed to radicalize viewers toward violent extremism.
3.4 Sexually Explicit or Exploitative Content
- Contains any sexual content involving minors. This is an absolute prohibition. We will report all such material to law enforcement and relevant internet safety organizations, and the account will be immediately and permanently terminated.
- Contains non-consensual intimate imagery or material commonly known as “revenge porn”.
- Contains adult sexual content that is not clearly labeled with the appropriate content rating as required by the platform’s rating system.
3.5 Harassing or Discriminatory Content
- Harasses, threatens, intimidates, or bullies specific individuals, including via coordinated or mass-reporting campaigns.
- Promotes hatred, violence, or discrimination on the basis of race, ethnicity, national origin, religion, gender, gender identity or expression, sexual orientation, disability, age, or other protected characteristics.
- Contains content designed to harm an individual’s reputation through falsehoods (defamation).
3.6 Deceptive or Misleading Content
- Contains materially false or misleading factual claims presented as true.
- Impersonates another person, organization, or brand in a way that is deceptive or likely to mislead viewers.
- Misrepresents the origin, authorship, or ownership of content.
- Presents sponsored or commercially motivated content as independently created or editorially neutral (undisclosed advertising).
3.7 Privacy Violations
- Exposes private or personally identifying information about real people — including home addresses, phone numbers, financial account details, or medical information — without their consent.
- Contains imagery of real individuals captured without their knowledge in situations where they had a reasonable expectation of privacy.
3.8 Spam or Low-Quality Abuse
- Is duplicated in high volumes with the intent to game discovery rankings, inflate analytics figures, or manipulate campaign performance metrics.
- Consists primarily of unsolicited commercial promotion unrelated to the stated content.
- Is submitted or published solely to test or probe platform systems rather than for genuine content distribution.
4. Prohibited Behaviors
4.1 Misuse of Platform Features
- Attempt to circumvent usage quotas, plan limitations, feature restrictions, or rate limits through technical or procedural means.
- Create multiple accounts or use shared accounts to avoid a ban, suspension, feature restriction, or plan requirement.
- Use automated tools, scripts, or bots to interact with the Service — including for uploading, viewing, clicking, or scraping — without our prior written permission.
- Use the Service in a way that places excessive or unreasonable load on our infrastructure, interferes with other users’ access, or degrades platform performance.
4.2 Security Exploitation
- Probe, scan, fuzz, or test the vulnerability of any part of the platform, its APIs, or any connected infrastructure without our prior written authorization.
- Attempt to gain unauthorized access to any account, database, administrative system, or network connected to the Service.
- Upload or transmit viruses, worms, ransomware, spyware, or any other malicious code.
- Conduct or attempt denial-of-service attacks, credential stuffing, brute-force attacks, or similar interference.
4.3 Abuse of Reporting and Moderation
- Submit false, frivolous, or malicious abuse reports against other users or their content.
- Use the reporting system as a tool to suppress legitimate content, silence critics, or harm competitors.
- Harass platform staff, moderation reviewers, or other users in connection with a dispute or appeal.
4.4 Misuse of Sponsorship and Brand Features
- Represent a brand in a campaign or brand mark without that brand’s authorization.
- Configure click-through URLs that direct viewers to malware, phishing pages, deceptive landing pages, or other harmful destinations.
- Use campaign or sponsorship tools to run advertising for products or services prohibited by applicable advertising law or industry standards.
- Artificially inflate campaign performance metrics — impressions, clicks, or conversions — through automated or coordinated means.
4.5 Platform Integrity
- Interfere with or disrupt the accounts, sessions, or experience of other users.
- Use the messaging or notification systems to send unsolicited bulk communications to other users.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service except to the extent expressly permitted by applicable law.
5. Enforcement
We take violations of this AUP seriously. When we identify or receive a credible report of a violation, we may take one or more of the following actions depending on the severity, frequency, and nature of the violation:
- Warning — a formal notice sent to your account for first-time or minor violations where the breach appears inadvertent or correctable.
- Content removal — removing specific media items, brand marks, overlays, or campaigns that violate this AUP.
- Feature restriction — temporarily or permanently disabling specific capabilities, such as publishing media, enabling embeds, creating campaigns, or accessing advanced analytics.
- Account suspension — temporary suspension of all platform access pending investigation or to prevent ongoing harm.
- Account termination — permanent closure of the account for serious, repeated, or irreversible violations. Terminated accounts are not eligible for refunds of any remaining subscription period.
- Legal referral — in cases involving illegal content (particularly child sexual abuse material, credible threats of violence, financial fraud, or other serious crimes), we will report to appropriate law enforcement authorities and cooperate fully with lawful investigations.
We reserve the right to act without prior warning in cases of severe, urgent, or imminent harm.
6. Appeals
If we take enforcement action against your content or account, we will attempt to notify you with a reason for the action. To appeal an enforcement decision:
- Email us at hello@cmark.media with the subject line: AUP Appeal – [Your Account / Content Reference].
- Clearly describe the content or action you are appealing.
- Explain why you believe the enforcement decision was incorrect, and include any relevant context, evidence, or supporting documentation.
We will review your appeal and respond within a reasonable timeframe. An appeal does not guarantee reinstatement, and we reserve the right to uphold enforcement decisions where we believe they are warranted.
7. Reporting Violations
If you encounter content or behavior on the platform that you believe violates this AUP, please report it to us at hello@cmark.media with a description of the violation and a link to the relevant content where possible. We treat all reports confidentially and will investigate them in good faith. We do not disclose the identity of reporters except as required by law.
8. Changes to This Policy
We may update this AUP as the platform evolves. We will notify you of material changes through the same process described in our Terms of Service. Continued use of the Service after the effective date of a revised AUP constitutes your acceptance of the changes.
